TRUSTEE SALES

In Arizona, a Trustee Sale is a creature of statute. The Beneficiary of a Deed of Trust directs the Trustee to commence a sale of the property which is the subject of the Deed of Trust because the Trustor breached one or more of its provisions. A Notice of Sale is recorded in the office of the county recorder where the property is situated. This Notice of Sale is served upon all parties who have a recorded interest in the property. A copy of the Notice of Sale is also posted on the property. A minimum of 90 days must pass before the property is sold. The Beneficiary of the Deed of Trust typically bids in all sums due and owing to him or her. Members of the general public may also enter a bid. The property is sold to the highest bidder.
