LITIGATION

Litigation is the process whereby one party sues the other party in a court of law for relief from some injustice. Relief in the real estate arena may take the form of recission of a contract, damages for breach of contract or damages for fraud or misrepresentation made in connection with a contract. Aggrieved parties may also initiate litigation to correct a title problem, remove an encumbrance or encroachment or establish or move a physical property boundary. Landlords and Tenants also resolve their complaints through litigation. Tenants may be evicted for nonpayment of rent or for destruction of property. Landlords may be ordered to repair certain property defects. Lenders may recover property thorugh judicial Foreclosures. The foregoing is only a small sample of the type of problems that may be brought to a court for resolution through the litigation process. Each specific set of facts should be thoroughly explored by an experienced attorney before deciding whether litigation should be pursued.
