
BOUNDARY & TITLE DISPUTES
Two of the more frequently
litigated issues in the real estate area involve boundaries and titles. A boundary
is defined as a physical property boundary. Disputes involving boundaries often
involve people who have built structures on their neighbor's property or have
failed to abide by set back restrictions. Title problems, on the other hand, involve
defects in title to the property which cloud ownership and make it next to impossible
to convey or even mortgage property without first resolving the problem. Sometimes
it is necessary to start a Quiet Title Action in order to get a court to judicially
remove impediments to a clear title.
